Karnataka Ban Stands: Supreme Court Stops ‘Hamare Baarah’ Release

Supreme Court stays release of 'Hamare Baarah' amid allegations of derogatory content; film already banned in Karnataka, pending Bombay High Court decision.

Today, the Supreme Court took action by staying the June 14 release of Annu Kapoor’s movie ‘Hamare Baarah’ after acknowledging allegations that the film is derogatory to the Islamic faith and married Muslim women.

A vacation bench, consisting of Justices Vikram Nath and Sandeep Mehta, noted the submissions made by lawyer Fauzia Shakil, representing petitioner Azhar Basha Tamboli, and directed the Bombay High Court to promptly make a decision on the plea.

The bench observed that all the offensive dialogues from the movie trailer persisted, prompting them to postpone the release of the film after viewing it in the morning.

The bench halted the screening of the film until the Bombay High Court disposed of the petition. Ms. Shakil noted that the high court lifted the stay on the movie’s release through an “unreasoned order.” She stated, “The high court couldn’t have instructed the CBFC to form a committee since the CBFC was a party with a vested interest in the litigation.”

The top court declared that all objections, including the directive to the Central Board of Film Certification (CBFC) to appoint the committee, remain open for the parties to raise before the high court.

The movie, already banned in Karnataka, was scheduled for release on June 14.
