‘Bail Is Rule, Jail Is Exception’: Supreme Court On Manish Sisodia’s Bail Order

Supreme Court grants bail to Manish Sisodia, citing trial delays and reinforcing the principle that bail is the rule.

Delhi Excise Policy Case: The Supreme Court granted bail to AAP leader Manish Sisodia on Friday, emphasizing that the trial process, involving 493 witnesses and over a lakh pages of documents, could take a considerable amount of time. The court noted that keeping Sisodia in jail for such an extended period without a trial conclusion would violate his fundamental rights. The bench highlighted that trial courts and High Courts must recognize that “bail is the rule, and jail is the exception.”

Concerns Over Prolonged Incarceration

Sisodia’s prolonged incarceration without a speedy trial was a central concern for the Supreme Court. The court remarked that denying bail effectively punishes the accused without a verdict, which should not happen. The justices also pointed out that Sisodia, who has deep roots in society, poses no flight risk, reinforcing the decision to grant bail.
