If the decision is in favor of Arvind Kejriwal, he will be released 6 months after his initial arrest by the enforcement directorate and two months after he was granted bail during elections.

Aam Aadmi Party leader, Arvind Kejriwal could not leave on July 12 as he had been arrested by the CBI a few weeks earlier, after the ED withdrew its challenge, in connection with the very same case.

Counsel for Mr Kejriwal, senior advocate Abhishek Singhvi, assailed the second arrest as a “sort of insurance” to keep Kejriwal behind bars to mount pressure on his party ahead of the Delhi election in February in various Fora, including the Supreme Court.

Arvind Kejriwal Qualified ‘Triple Test’ For Bail

He also pointed out that his client had already satisfied the ‘triple test’ for bail last week during the final hearing before the court began its deliberation, as the same court had granted him bail in the ED case earlier.

CBI has consistently flagged what it sees as a mountain of evidence against Mr. Kejriwal. Most of these evidences are given by ‘approvers’, or former accused who have been pardoned, or will get lighter sentences in exchange for testifying against the Chief Minister.

ED Considers Delhi CM In Pivotal Position

Like the ED, the agency considers Mr. Kejriwal to be in a pivotal position regarding preparation and approval of the controversial liquor policy in November 2021, which was rolled back eight months thereafter.

However, the contention of CBI that his release now, after the High Court had refused relief to Mr. Kejriwal, would “demoralize” that court was rejected by the court. “Don’t say that.” the bench of Justice Ujjal Bhuyan and Justice Surya Kant, who will deliver today’s judgment said.
