New Delhi: The Supreme Court Wednesday agreed to list a plea for hearing on February 24, which demands menstrual pain leave for female students as well as working women across India.

Chief Justice of India DY Chandrachud was hearing the plea which stated that menstrual periods have been largely disregarded across the nation, reported Bar and Bench. It also mentioned that, however, there are a few organisations and the state governments who have taken measures to ensure leaves to females during the menstrual pain.

The plea highlighted those companies who give such benifits to their female employees. The list included Ivipanan, Zomato, Byju’s, Swiggy, Mathrubhumi, Magzter, Industry, ARC, FlyMyBiz, and Gozoop.

The petitioners urged the apex court to issue directions to the state governments so the latter establish regulations that provides leave to the female students and workers.

The PIL also drew notice on the Section 14 of the Maternity Benefit Act that involves the appointment of inspectors to enforce the Act’s provisions. It asked the top court foreffective implemention of the same.

As per an online research, mentioned the plea, only Meghalaya had issued a notice in 2014 for the appointment of such officers. Meanwhile, Bihar was the only state to provide special leave benefits under a 1992 policy.

Denying the menstrual leave to female in the remaing states, is a violation of their right to equality under Article 14 of the Constitution, stated the plea.
