Part V

The Constitution of India is divided into 25 Parts. Part V particularly focuses on the ‘Union Government’. This part is divided into five chapters out of which Chapter 1 i.e., The Union Executive. Article 64 provides that the Vice-President of India shall be ex officio Chairman of the Council of States and shall not hold any other office of profit.

Interpretation of Article 64 of Indian Constitution

Article 64 of the Constitution states - “The Vice-President shall be ex-officio Chairman of the Council of States and shall not hold any other office of profit:Provided that during any period when the Vice-President acts as President or discharges the functions of the President under article 65, he shall not perform the duties of the office of Chairman of the Council of Stales and shall not be entitled to any salary or allowance payable to the Chairman of the Council of States under article 97.”

The Vice-President of India serves as the Chairman of the Rajya Sabha - 

  • oversees sessions of the Upper House
  • maintains decorum
  • ensures the smooth functioning of legislative proceedings
