The case at hand revolves around Rekha who was a working woman and Yarappa Reddy who worked as a milk trader. The two were involved in a love affair that ended tragically. 

Background of the Case

Rekha was living in a college hostel and was pursuing her degree in B.A. However, she moved to the house of her relative for further studies after failing in final exams. After moving to her relative’s house she became friends with Anitha who was the daughter of her relative. Yarappa, who was living nearby developed an obsession with Rekha which later evolved into a romantic relationship marked by exchanged love letters. Rekha later secured a job as a Receptionist at “Acad Coach Builders” and was promoted to Cashier.

Relationship Tensions

Initially, their relationship was happy but tensions arose when one of their love letters reached Rekha’s father. He confronted her which led to a promise from Rekha not to pursue the affair and not to marry against the wishes of her parents. Despite this, Yarappa continued to visit her and was determined to marry her which Rekha resisted. This refusal led Yarappa to contemplate either reclaiming Rekha or killing her.

The Incident

On the day of the incident, Rekha went to work. Yarappa persuaded her to accompany him to another location to discuss their relationship. He took her to the house of Sharadamma who was a family friend and introduced Rekha as his fiancée. At the house of his family friend, the conversation turned violent. Yarappa pulled out a chopper from his bag and attacked Rekha. Sharadamma rushed into the room upon hearing the scream of Rekha and found her lying in a pool of blood. Yarappa with the bloodied chopper in hand confessed to Sharadamma that he had killed his fiancée before fleeing the scene.

Surrendered to the Police

After the incident Yarappa surrendered to the local police station and handed over the bloodstained chopper to Sub-Inspector Thimmaiah. The Sub-Inspector recorded his statement as the first information report. The police returned to the house of Sharadamma where the body was found. A post-mortem revealed nine ante-mortem injuries including four stab wounds with the fatal injury being a stab wound to the chest that damaged vital organs.

Decision of the Trial Court

The Trial Court relied on the testimony of the Sharadamma and the circumstantial evidence presented. The Trial Court convicted Yarappa under Section 302 of the Indian Penal Code and sentenced to life imprisonment. 

Appeal in the High Court of Karnataka

Aggrieved by the decision of the Trial Court, an appeal was filed in the High Court of Karnataka. However, the High Court disregarded the testimony of the Sharadamma and criticized the investigation and accepted the defense argument that the injuries on Rekha could not have been inflicted by the chopper used by Yarappa and thereby, acquitting him.

Appeal in the Supreme Court

Aggrieved by the decision of the High Court, the State of Karnataka filed an appeal in the Supreme Court against the acquittal of Yarappa.

Section 159 of the Indian Evidence Act, 1872

Section 159 of the Act deals with refreshing memory. It states that a wittness may, while under examination, refresh his memory by referring to any writing made by himself at the time of the transaction concerning which he is questioned, or so soon afterwards that the Court considers it likely that the transaction was at that time fresh in his memory.

The witness may also refer to any such writing made by any other person and read by the witness within the time aforesaid, if when he read it he knew it to be correct.

When a witness may use a copy of a document to refresh his memory- Whenever a witness may refresh his memory by reference to any document, he may, with the permission of the Court, refer to a copy of such document : Provided the Court is satisfied that there is sufficient reason for the non-production of the original. An expert may refresh his memory by reference to professional treatises.

Judgment and Impact of State of Karnataka vs Yarappa Reddy

The Supreme Court in this case examined the investigation conducted by the Police and the validity of the Station House Diary. The Court agreed with the findings of the High Court and noted that the version of events stated by the Police lacked credibility especially regarding the statement made by the accused which cannot be admitted as evidence if it includes inculpatory statements.

The Court in this case highlighted that the overall credibility of other evidence must be considered independently. The Court highlighted the testimony of Sharadamma as an important piece of evidence. The High Court had dismissed the evidence based on the claim that no neighbors responded to murder of Rekha and questioned Sharadamma’s reaction during the incident. The Supreme Court rejected these points and asserted that individual reactions to traumatic events varies and that testimony of Sharadamma was consistent with the case of the Prosecution.

The Supreme Court found the evidence compelling enough to restore the conviction and sentence imposed by the Trial Court. The Court allowed the appeal and directed Yarappa immediate imprisonment to serve the remainder of his sentence.
