Current Status of International Criminal Law Regarding CAH

Specific acts under CAH include murder, torture, and rape within organized attacks targeting civilians. The crimes Against Humanity first got codification in the London Charter for the Nuremberg Tribunal of 1945 where the latter conducted war crime trials with Nazi leaders. Unlike Genocide and war crimes, CAH lack an international convention specifically designated to it.

Currently, Crimes Against Humanity (CAH) are mainly regulated by the Rome Statute of the International Criminal Court (ICC).

About the Rome Statute

The Rome Statute is an international treaty that established the International Criminal Court (ICC) in 1998. The ICC started functioning in 2002 in The Hague, Netherlands.

  • The ICC is the first permanent international criminal court in the world. Its primary purpose is to prosecute individuals (not states) for four main categories of international crimes:
    • Genocide
    • Crimes against humanity
    • War crimes
    • Crime of aggression
  • The court has jurisdiction only over crimes committed after July 1, 2002, when the Rome Statute took effect.
  • The ICC works on the principle of complementarity - it only acts when national courts are unwilling or unable to prosecute.
  • The ICC can carry out investigations, issue arrest warrants, conduct trials, and inflict imprisonment as a sentence among others.
  • India is not a signatory to the ICC since India has not ratified nor signed the Rome Statute
    • China, Israel, Russia, and the United States are also not signatories to the Rome Statute.

Advantages of Having a Dedicated CAH Treaty

Benefits of having a dedicated CAH treaty include the following:

  • Jurisdictional Limitations: The International Criminal Court (ICC) jurisdiction is limited on non-member states, leading to accountability gaps in penalizing CAH perpetrators.
  • State/Country Accountability: Contrary to the Rome Statute, a CAH treaty will allow holding the states/countries responsible for failure to prevent crimes against humanity instead of only punishing individuals responsible.
  • Legal Structure: With a specific treaty, a case can be brought before the ICJ under the same rules as applied in the case of Gambia when it sued Myanmar under the Genocide Convention.
  • Prevention Duty: States will be bound to undertake concrete administrative, legislative, and judicial measures to prevent crimes against Humanity.
  • Scope Enlargement: The treaty opens scope for incorporating new crimes such as gender apartheid, terrorism, and crimes against indigenous populations.

India's Objections to the CAH Treaty

India’s concerns with the CAH treaty include:

  • Redundancy: India raises its apprehension about reduplication of the current Rome Statute regime
  • National Sovereignty: India emphasizes that national law and courts are better equipped to deal with such crimes.
  • Armed Conflict Vs Peacetime: India contends that only those crimes committed during armed conflicts should be classified as Crimes Against Humanity, not those in peacetime.
  • Issue of Terrorism: India supports the inclusion of terrorism as a CAH.
