The Fundamental Relationship between International Law and Municipal Law

International law and national law operate separately but are also connected because countries participate in both systems.

Dualism vs. Monism

  • Dualism says that international law and national law are separate systems with different sources and subjects. This means the two laws are not automatically connected. 
    • For a country to comply with international law, it has to change its own national laws.
  • Monism says that international law and national law are part of one legal system. This means international law is automatically included in national law. 
    • Countries have to follow international law even if their own laws do not specifically mention it.

Principle of Pacta Sunt Servanda

  • Pacta sunt servanda means "agreements must be kept." It is a core principle of international law. 
  • It means countries have to fulfill the promises they make in treaties and agreements. 
  • If national laws conflict with those treaties, the national laws have to be changed to comply with international law.

Hierarchy and Primacy

When international law and national law disagree, the question comes up - which law takes priority? Different legal systems handle this issue differently.

  • In dualist systems:

International law is seen as more important than national law. So international law takes precedence in cases of conflict.

  • In monist systems:

National law is seen as more important than international law. So national law takes precedence in cases of conflict.

Direct and Indirect Incorporation

Countries incorporate international law into their domestic legal systems through either direct or indirect methods.

  • Direct incorporation involves explicitly adopting international law into domestic law. This can be done through legislation, court decisions, or other means.
  • Indirect incorporation occurs when courts interpret domestic law in light of international obligations. This means that courts will apply international law even if it is not explicitly written into domestic law.

People have tried to coordinate the relationship between international and national law. They use different methods to connect the two laws:

Domestic Implementation Measures

Countries can pass laws, form special courts or assign authorities responsible for implementing and enforcing international legal obligations within their own legal system.

National Courts as Agents of Harmonization
